This policy explains how Magine Studios, Inc. (“Magic Story,” “we,” “us,” or “our”) handles personal information when you use magicstory.com, our apps, and related services. It also explains the choices available to you.
Our services let adults create personalized stories for children. In this policy, “you” means the adult using our services, including a parent or guardian providing information about a child. Our Terms of Service also apply.
Photos and AI
When you create an avatar for a personalized book, we do not save the original photo you upload. We save the illustrated avatar created from it so you can personalize your stories.
We do not use customer data, including uploaded photos and generated avatars, to train AI models.
Information we collect
The information we receive depends on how you use our services:
- Account and contact details: your name, email address, phone number, login details, and preferences.
- Personalization details: the names, ages, appearance details, prompts, generated avatars, and other content you provide or create for a story. Original photos used to create a personalized-book avatar are handled as described above.
- Orders and subscriptions: billing and shipping details, order history, subscription status, and payment confirmations. Payment providers and app stores process payment card information; we do not store full payment card numbers.
- Communications: support requests, reviews, survey responses, promotion entries, email and text-message history, delivery and engagement data, preferences, and consent records.
- Device and usage information: IP address, browser and device type, page visits, interactions, referral information, cookie identifiers, and diagnostic data.
We also receive information from services you choose to use with Magic Story, such as a sign-in provider, app store, or payment provider. Those services may have their own privacy policies. When an app asks to use a device feature, you can manage that permission in your device settings.
Please provide only information needed for the service you request. Do not upload government identity documents, financial credentials, medical records, or content you do not have permission to use.
How we use information
- Provide accounts, generate personalized stories and artwork, maintain your library, process payments, and print and deliver your orders.
- Manage subscriptions, respond to support requests, and send service messages such as order confirmations and account or security notices.
- Understand how the service performs, diagnose problems, and improve its features and reliability. This does not include training AI models on customer data.
- Send marketing communications in accordance with your choices and applicable law, and measure the effectiveness of our advertising.
- Protect customers and our services, prevent fraud and misuse, enforce our terms, comply with legal obligations, and establish or defend legal claims.
Cookies and advertising
We use cookies, local storage, pixels, and similar technologies to keep you signed in, remember preferences, maintain carts, measure usage, and understand which advertising led to a visit or purchase. Some information is sent through server-side events as well as browser-based tools. This can include page and purchase activity, device identifiers, IP addresses, and advertising identifiers.
Analytics and advertising providers may receive this information. Depending on the law that applies and how a provider uses it, advertising-related disclosures may be treated as a “sale,” “sharing,” or processing for targeted advertising. These terms can apply even when no money is exchanged for the information.
You can manage cookies through your browser and advertising permissions through your device settings. Blocking cookies may affect sign-in, saved preferences, or checkout. For questions or requests about advertising-related disclosures, contact us using the details below. Browser settings do not necessarily stop every server-side disclosure.
When we share information
- Service providers: companies that help us provide hosting, storage, authentication, AI processing, payments, printing, shipping, customer support, communications, analytics, and advertising measurement. Information is provided as needed for the relevant service.
- At your direction: for example, when you choose to publish a review, submit a public promotion entry, or use a sharing feature. Publicly shared content may be copied or viewed by others.
- Legal and safety needs: where required by law or where we reasonably believe disclosure is necessary to protect rights, investigate fraud or abuse, comply with valid legal process, or obtain professional advice.
- Business transactions: in connection with a merger, financing, acquisition, or sale of assets, subject to applicable law and the commitments in this policy. We will provide notice before information becomes subject to a different policy.
- With your consent: for another purpose we explain when asking for that consent.
Mobile opt-in and consent information is not shared with third parties or affiliates for their own marketing or promotional purposes. Service providers may process it to deliver and manage our messaging program.
Retention and deletion
We retain account information, generated avatars, stories, and order records for the purposes described in this policy, including providing your library, fulfilling orders, meeting legal and accounting obligations, preventing fraud, and resolving disputes. These records are distinct from the original photos used to create personalized-book avatars.
To request account or content deletion, contact us at support@magicstory.com. Canceling a paid subscription is separate from deleting your account or personal information.
- When you close your account, its content becomes immediately inaccessible and should be purged from our systems in full within 90 days.
- Content removed individually may remain on active servers for up to 30 days, and copies may be held in backups afterward.
- These retention periods may be extended if required for legal purposes, such as litigation holds, law enforcement requests, or specific tax or financial audits.
Information that has been anonymized so it can no longer be associated with you may be retained for analysis and service improvement. The no-training commitment above still applies.
Your privacy choices
- Account information: update available details in your account or contact support for help accessing, correcting, or deleting personal information.
- Email: use the unsubscribe link in a marketing message. We may still send necessary service messages about your account or purchases.
- Text messages: follow the opt-out instructions in a message or contact support. Marketing consent is not a condition of purchase. See the text-message terms for more information.
Depending on your location and applicable law, you may have rights to access or obtain a copy of your information, correct it, request deletion, object to or restrict certain processing, withdraw consent, or opt out of sale, sharing, or targeted advertising. California residents may also have rights concerning certain uses of sensitive personal information. We will not unlawfully discriminate against you for exercising privacy rights.
Send a request to support@magicstory.com. We may need information to verify your identity or an authorized agent's authority. Please do not send passwords or full payment card details. Rights are subject to applicable exceptions and response periods. Where available, you may appeal a decision by replying to our response or complain to your local privacy regulator.
Children’s privacy
Accounts and purchases are intended for adults aged 18 or older. An adult creating a story may provide information about a child. You must be the child's parent or guardian, or have their permission, before submitting the child's information or likeness.
We do not knowingly collect personal information directly from children under 13. If you believe a child has submitted information without appropriate permission, contact us so we can investigate and take appropriate steps to remove it. Parents and guardians may also contact us about information they have provided for a child.
Security and international processing
We use reasonable safeguards designed to protect personal information. No online service, transmission method, or storage system can guarantee absolute security.
Magic Story and its service providers may process information in the United States and other countries, where data-protection laws may differ from those in your location. We remain responsible for the commitments in this policy and for safeguards required by applicable law. Contact us with questions about where your information is processed.
Links to third-party websites and services are governed by those providers' own privacy practices. Please review their policies before giving them personal information.
Changes to this policy
We may update this policy and will change the date above when we do. For material changes, we will provide appropriate notice, such as an email or a prominent notice on our site, before the change takes effect. Where required, we will obtain consent. An update does not give us permission to disregard commitments made when we collected your information.
