Official Rules: Magic Story Wild & Wacky Costume Sweepstakes
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. U.S. RESIDENTS ONLY.
1. Sponsor
The Sponsor of this Sweepstakes is Magine Studios, Inc. (“Magic Story” or “Sponsor”), located at 5318 E 2nd St #901, Long Beach, CA 90803.
2. Eligibility
The Magic Story WILD & WACKY COSTUME Sweepstakes(the “Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age or older at the time of entry.
THIS SWEEPSTAKES IS VOID AND INELIGIBLE TO RESIDENTS OF ANY JURISDICTION OUTSIDE OF THE UNITED STATES, INCLUDING BUT NOT LIMITED TO ALL FOREIGN COUNTRIES, U.S. TERRITORIES, AND POSSESSIONS.
Employees, officers, and directors of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and the immediate family members (spouse, parents, siblings, and children) and/or those living in the same household of each such individual are not eligible to participate. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.
3. Entry Period
The Sweepstakes will run weekly, beginning on October 6, 2025 and ending each subsequent Sunday (the “Weekly Entry Period”). The Sweepstakes will officially conclude on November 2, 2025.
4. How to Enter (No Purchase Necessary)
There is one (1) method of entry: Creating and Submitting Content.
To enter, you must:
- a) Create Content:Use Magic Story’s Costume Try On tool to create a photo or video of a character in a costume.
- b) Post: Post the created photo or video (“Entry”) on Instagram.
- c) Include: Include the official Sweepstakes hashtag: #MagicStoryCostume in the post caption.
- d) Compliance: The Entry must strictly adhere to the Content Submission Requirements (Section 5) and the Child Safety & Consent Requirements (Section 6).
Limit: There is no limit of entries per person, per Weekly Entry Period. All Entries become the property of the Sponsor and will not be acknowledged or returned.
5. Content Submission Requirements (UGC)
By submitting an Entry, you warrant and represent that your Entry:
- a) Originality and AI Tool Use:Must be created entirely by the Entrant using Magic Story’s Costume Try On tool.
- b) Character Focus: Must feature your character in a costume.
- c) Propriety: Must NOT contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous, libelous, sexually explicit or suggestive, promotes bigotry, racism, hatred, or harm against any group or individual.
- d) Third-Party Rights: Must NOT violate or infringe upon any third-party rights, including, without limitation, trademark, copyright, right of publicity, or privacy.
- e) Intellectual Property: You warrant that the Entry is your original work and does not use any third-party intellectual property (such as logos, brand names, or copyrighted characters) without express, written permission.
6. Child Safety & Consent Requirements (Strict Enforcement)
The following rules are mandatory for all Entries involving minors:
- a) Parental/Guardian Status: The Entrant must be the legal parent or guardian of any child character featured in the photo or video and must have the full legal right to submit the costume photo or video.
- b) No Explicit Material: The photo or video must not contain any material that is sexually explicit, suggestive, or in any way harmful or indecent toward a minor.
- c) Right to Audit:Sponsor reserves the right to request proof of the Entrant’s parental or guardian status before declaring them a winner.
- d) ZERO TOLERANCE POLICY: Any attempt to submit Input or create any Output, pictures, or videos that are explicit, sexually suggestive, obscene, or harmful to minors will result in the immediate and permanent disqualification of the Entrant. Sponsor reserves the right, in its sole discretion, to block the Entrant’s account from all Services and to report any suspicious or illegal activity to law enforcement and/or appropriate governmental and child protection agencies.
7. Winner Selection
One (1) winner will be selected at random from all eligible Entries received during the applicable Weekly Entry Period. The random drawing will occur on or around every Monday following the end of the Entry Period. Odds of winning depend on the number of eligible Entries received during the Weekly Entry Period.
8. Prize
Prize:One (1) year of free access to the Magic Story+ Subscription (Approximate Retail Value “ARV”: $419.88).
Prize Conditions:The prize is non-transferable and no substitution will be made except at the Sponsor’s sole discretion. The winner is responsible for any applicable federal, state, and local taxes and any other costs or expenses associated with the acceptance or use of the prize.
9. Notification and Verification
The potential winner will be notified via Direct Message on Instagram within 10 days of the drawing. The potential winner must respond within forty-eight (48) hours of initial notification.
The potential winner will be required to sign and return an Affidavit of Eligibility, Liability Release, and a Publicity Release (where legally permissible), and Verifiable Consent for any likeness to be used, all within 7 days of notification. Failure to comply with these requirements will result in forfeiture of the prize.
10. Rights Granted by Entrant
By submitting an Entry, you grant the Sponsor, its licensees, and designees an irrevocable, perpetual, royalty-free, worldwide, non-exclusive licenseto reproduce, distribute, display, and create derivative works of the Entry (including the character’s likeness) for use in connection with the Sweepstakes and the promotion of Magic Story’s products and Services, in any media, now known or hereafter devised, including without limitation, on the Internet and in advertising and promotion.
11. Release of Liability and Indemnification
By entering, you agree to release and hold harmless the Sponsor and its subsidiaries, affiliates, partners, and their respective officers, directors, employees, and agents from and against any claim or cause of action, including, but not limited to, any claims of damage to a minor child’s right of publicity or privacy, or intellectual property infringement, arising out of participation in the Sweepstakes or receipt or use/misuse of the prize.
You agree to indemnify the Sponsor for any claims arising from your breach of the Child Safety & Consent Requirements (Section 6) or any claim that your Entry infringes the intellectual property or publicity rights of a third party.
12. Limitation of Liability and Applicable Law
BY ENTERING THIS SWEEPSTAKES, YOU ACKNOWLEDGE AND AGREE THAT YOU WAIVE YOUR RIGHT TO SUE THE SPONSOR AS A MEMBER OF A CLASS IN ANY ACTION ARISING OUT OF OR RELATING TO THIS SWEEPSTAKES.
GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules.
DISCLAIMER OF COMPLIANCE: The Sponsor makes NO REPRESENTATION OR WARRANTY that this Sweepstakes complies with the registration, bonding, or disclosure requirements of all U.S. states. By entering, you agree to hold the Sponsor harmless for any non-compliance with the specific laws of the state in which you reside.
13. General Conditions
Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules.
14. Winner’s List
